What is Fisq? And When Does the Muslim Becomes a Faasiq? Extracted from Muhaadhiraat Fil Aqeedah wa Da?wah  Pg. 382-383  By  Sheikh Saalih Bin Fawzaan Bin Abdillaah Al-Fawzaan


Al-Fisq: it is to depart from the obedience of Allaah and it is classified into two categories. Fisqul Kufr [1]  and Fisq Maa Doona Kufr[2] - and Fisq Maa Doona Kufr does not cause one to exit the Millah [deen] but it does cause ones? imaan to diminish and in it is a type of departing, but not a departing that causes one to depart from Islaam and it does not make him a Faajir however it does make him a Faasiq [3].  So the Muslim becomes a Faasiq when he perpetrates a major sin from amongst the major sins, like Zinaa [fornication] and partaking in the drinking of intoxicants and stealing and utilizing Ribaa and what is similar to that from amongst the major sins when he does not consider it permissible to do so. Indeed he only perpetrates these [major sins] being guided by his Hawaa [desires] and Shahawah [lowly cravings]. Then verily he shall be counted as a Faasiq.

Ahlus Sunnah wal Jamaa?ah rule upon him that he is indeed a believer deficient in his Imaan or a believer in his Imaan disobedient due to his kabeerah [major sin] and counted amongst the believers and from amongst the people of Tawheed when he does not posses a quality from amongst the qualities of shirk which exits a person from the Millah [deen] then that which remains with him in name is Al-Imaan and Al-Islaam, so that he remains muslim except that he is deficient in his Imaan. And this is what is called Fisq  or Faasiq. And when he perpetrates a major sin which necessitates the Hadd [punishment] then the Hadd is to be established upon him however with this he is still to be counted amongst the believers. And he is to be treated [and interacted with] as a believer is to be interacted with and that is because if he wasn?t from amongst the believers then the Hadd would not have been sufficient upon him, rather he would have been definitely killed and that is because the apostate is to be killed as a result of the statement [of the prophet] [sallallahu Alayhi wa salam] ?Whoever changes his deen then kill him? [collected by Bukharee from the hadeeth of Ibn Abaas]

So the [fact] that the Hadd is to be established upon him indicates that he is from Ahlul Imaan
and he is to be interacted with as the interactions of the believers and he is to be shown Walaa in accordance to what he exemplifies of Imaan and he is to be hated in accordance to what he exemplifies of disobedience and that is because he has not departed from the daa?iratul Imaan [circle of Imaan] and this is the Madhhab of Ahlus Sunnah wal Jamaa?ah.?

[1]Fisqul Kufr: is a type of sin which is a departure from the obedience of Allaah which causes the perpetrator of it to exit the fold of Islaam.

[2]Fisq Maa Doona Kufr: is a type of sin which is a departure from the obedience of Allaah which does not cause the perpetrator of it to exit the fold of Islaam which is similar to a minor sin.

[3] According to Ibn Mandhoor [rahimahullaah] the compiler of Lisaanul Arab when he mentioned Fisq he defined it as: disobedience and the abandonment of the command of Allaah Azza wa Jall and a type of deprarting from the path of truth. 5/128
