One who dies, in debt, are his debts obligated upon the ummah? Is Jannah harraam for him until his debts are paid??

بسم الله الرحمن الرحيم

Q- I am a man who wants to perform the obligation of Hajj this year, but I have borrowed a sum of money from the bank, and I pay back the sum in monthly installments, which extend until after six months from now.  Is it obligatory for me to make Hajj ? knowing that I borrowed this sum before thinking about performing this obligation (of Hajj), and for another purpose.  Please inform us about this, Jazaakallaahu khairan.

A- If you can afford both the expenses of Hajj and paying back the debt in time, it is obligatory for you to make Hajj, based on the generality of the statement of Allah:
و لله على الناس حج البيت من استطاع إليه سبيلا
?And making Hajj to the House (Kaabah) is a duty mankind owes to Allaah ? for he who is able to make the journey.? 3:97
But if you cannot afford both the expenses of Hajj and paying back the debt, it is not obligatory for you to make Hajj, because of the (previously mentioned) Aayah and the Ahaadeeth of the Messenger which carry the same meaning.

Q- Is Hajj obligatory upon one who is in debt?

A- If one owes a debt which engrosses all of his money, it is not obligatory for him to make Hajj, because Allah only obliged Hajj upon he who is able.  Allah ta?aalaa said:
و لله على الناس حج البيت من استطاع إليه سبيلا
?And making Hajj to the House (Kaabah) is a duty mankind owes to Allaah ? for he who is able to make the journey.? 3:97
And he who owes a debt that takes up all he has is not able to make Hajj.  Because of this, he must pay his debt, then, when he is able to make Hajj, let him do so.
     However, if the debt is less than what he has, so that enough money remains to make Hajj after paying back the debt, (in this case) he should pay his debt, then make Hajj, be it (the Hajj) obligatory or voluntary?

I understand clearly from your scenerios, insha-Allah this is sufficient unless an established dhaleel becomes apparent.

It would be great to go off for hajj with no debts, so if you die, you could die free of debt.  And in general we should try to be without any debts, when going for hajj or otherwise.  However, "I don't know any proof to say that a person is prohibited from making hijrah or hajj until he pays off all his debts."

For those who claim that a man must be free of debt or have permission from those he owes money to in order to make hajj, we need to hear their evidence.  Furthermore, if a man settles all his debts and goes to Makkah, and while he is on the airplane a phone bill arrives in his mailbox back home, will they say he has to return now since there is now a debt on him?

(A phone bill in this instance is a debt, since it is a request of payment for services rendered, and if he died during that hajj it would have to be paid from his estate before his relatives get their inheritance.)

Or perhaps I am not understanding the issue properly, wallaahu a'lam.

What about the shaheedoon not being able to enter paradise unless their debts are cleared?

As far as making Hajj, can't the person with debt let their debtor know that they are making Hajj with their debt money in order to make their Hajj and the debtor has to give the debtee conscent to make Hajj with their owed money? I heard of this before...

wa 'alaykumus-salaam

I don't know any proof to say that a person is prohibited from making hijrah or hajj until he pays off all his debts.  I remember some of our financially challenged brothers turning down a free hajj ticket because they had debts, subhaan Allaah!

As-Salaamu' Alaikum.

Actually this is the case, the individual did sign a one year agreement with the above stipulations and due to circumstance has to move, so basically he could not make hijrah or hajj until he pays the leasing agreement out?

it depends on the agreement

if he agrees to pay for one year's rent in monthly installments, and he signs in agreement that if he leaves he still must pay rent for the remainder of the year or until the landlord finds another tenant, then this is binding on him, since he has made a contract with this stipulation, and it is a halaal agreement.  However, this may not be the case depending on the actual contract.  And Allaahu knows best.

I have a question in need of dhaleel I do not have access to. If an individual Muslim breaks a leasing/ house or apartment renting agreement is this considered a debt?
