As salaamu alaikum

If some of the students are living close to some of the Scholars, please see if you can ask this question; as it is Ramadan and it is difficult to call during this time.

There are differnt opinions as to what should be done by the pregnant or breast-feeding woman after Ramadan.

This is from Sheik Fawzan...

متى يُباح الفطر في رمضان للحامل والمرضع؟ وما هي مفسدات الصوم عمومًا؟ وهل يجوز للمرأة أن تتناول الحبوب المانعة للعادة الشهرية حتى تتمكن من صيام رمضان بدون انقطاع؟



نص الفتوى  

الحمد لله
يجوز الإفطار للحامل والمرضع إذا خافتا على ولديهما من أضرار الصيام؛ لأنه يمكن أن الصيام يضعف الغذاء الذي يتغذى به المولود في بطن أمه؛ فإذا كان الأمر كذلك؛ فلها أن تفطر وأن تقضي من أيام أخر وتطعم مع القضاء، وإن خافت على نفسها من الصيام؛ لأنها لا تستطيع الصيام وهي حامل أو لا تستطيع الصيام وهي مرضع؛ فهذه تفطر وتقضي من أيام أخر وليس عليها إطعام. هذا ما يتعلق بالحامل والمرضع.
ويجوز للمرأة تناول الحبوب التي تمنع عنها الحيض من أجل أن تصوم إذا كانت هذه الحبوب لا تضر بصحتها.

السؤال الثامن :

ما حكم المرأة الحامل إذا أفطرت في رمضان خوفاً على جنينها ، والمرأة على رضيعها ؟
جواب : اختلف العلماء ، فمنهم من يقول : يجب عليها أن تقضي ومنهم من يقول : تقضي وتُكفر ، ومنهم من يقول : ليس عليها قضاء وعليها كفارة ، ومنهم من يقول : ليس عليها قضاء ولا كفارة ، ويستدل بحديث أنس بن كعب الكلبي أنه قدم إلى النبي صلى الله عليه وعلى آله وسلم فقال له : (( كل )) قال : إني صائم ، قال : (( أما علمت أن الله وضع شطر الصلاة عن المسافر ، والصوم عن الحامل والمرضع )) ، فاستدلوا بهذا على أنه ليس عليها شيء .
والذي يظهر لي أن عليها القضاء فقط ، فلا تلزمها كفارة ، ولا تجزئ ، فيلزمها القضاء لقوله تعالى : ( فمن كان منكم مريضاً أو على سفر فعدة من أيام أخر ) [ البقرة : 184 ] .

And this is from Sheik Albaane...

قرأت في كتاب صفة صوم النبي صلى الله عليه وسلم في رمضان لمؤلفه [سليم الهلالي وعلي حسن عبد الحميد ]أن الحامل والمرضع، إذا خافتا على نفسيهما أو لديهما ، أفطرتا وأطعمتا عن كل يوم مسكينا ولا يجب عليها القضاء، فما صحة هذا القول؟ نرجو التوضيح جزاكم الله خيراً

  

نص الفتوى  
لا يجب عليها القضاء وإنما يجب عليها الكفارة عن كل يوم مسكينا، هذا الجواب جواب صحيح، أما الاشتراط المذكور وهو: إذا خافت الحامل والمرضع على نفسيهما أو ولديهما، هذا الشرط إنما هو اجتهاد من بعض العلماء لا تكلف به الحامل أو المرضع لأن النبي صلى الله عليه وسلم قد قال [إن الله تبارك وتعالى قد وضع الصيام عن الحامل والمرضع ]، ثم قال ابن عباس في تفسير قوله تعالى [فمن كان منكم مريضا أو على سفر فعدة من أيام أخر وعلى الذين يطيقونه فدية طعام مسكين] قال ابن عباس رضي الله عنه: إن الحامل والمرضع عليها الإطعام، أي لا يوجد هناك الشرط المذكور آنفا أن تخاف الحامل أو المرضع على نفسها أو على ولدها. خلاصة الجواب: يجوز لكل حامل ولكل مرضع أن تفطر وأن تطعم عن كل يوم مسكينا، ولا قضاء عليها إلا هذه الكفارة.  



The question is, with these vastly different opinions, and every Scholars has his proof,and we do not know which proof is stronger, can the common folks like us just take the opinion which is easier for us?



وَكَانَ الْفُضَيْل بْن عِيَاض يَقُول : يَا كَذَّاب يَا مُفْتَرٍ , اِتَّقِ اللَّهَ وَلَا تَسُبَّ الشَّيْطَان فِي الْعَلَانِيَة وَأَنْتَ صَدِيقُهُ فِي السِّرّ

Translation:

This is from Sheik Fawzan...

"When is breaking the fast in Ramadhan permissible for the pregnant woman and the woman who is breast feeding and what are the things that corrupt the fast in general? Is it permissible for a woman to take tablets that prevent her from having her menstruation in order for her to complete fasting Ramadhan without breaking her fast?"

The text of the Fatwaa:

"Al-Hamdulillah,

Breaking the fast is permissible for the pregnant woman and the woman who is breast-feeding if they fear for their babies because of the harms that the fast may bring. It is possible that the fast can weaken the food that the baby eats in its mother?s belly. If this is the case then she may break her fast, make up the days, and feed along with making up the days. If she fears for herself from the fast because she can't fast while pregnant or while breast-feeding then in this case she should make up the days and she does not have to feed. This is regarding the pregnant woman and the woman who is breast-feeding.

It is permissible for the woman to take tablets that prevent her menstruation so that she can fast if these tablets don't harm her health."

Question number eight:

"What is the ruling of the pregnant woman if she breaks her fast in Ramadhan out of fear for her baby and the woman who breaks her fast out of fear for her baby who is breast feeding?"

Answer:

"The Scholars differ so their are those from them who say she must make up the days and others say she must make up the days and feed. Some say she does not have to make up the days but she must feed. Some say she does not have to make up the days and she does not have to feed and their evidence is the Hadeeth of Anas ibn Ka'b Al-Kalbee that he came to the Prophet Sallallahu alaihi wa sallam and the Prophet said to him: "eat". He said: "I'm fasting". The Prophet said: "Do you not know that Allah has removed part of the Salaah from the traveler and the fast from the pregnant and breast feeding women?" This is their proof that she does not have to do anything. That which is apparent to me is that she should only make up the days. She does not have to feed and feeding is not sufficient. She must make up the days because of the statement of Allah Ta'aalaa: "and whoever from you is sick or on a journey then a number of other days."

In addition, this is from Sheik Albaane...

I read in the book: "the description of the fast of the Prophet Sallallahu alaihi wa sallam in Ramadhan? (By Ali Al-Halabi and Saleem and Al-Hilaalee) that the pregnant woman and the breastfeeding woman when they fear upon themselves or their babies they may break their fast. They may feed a needy person for each day and they don't have to make up the days. How correct is this statement? We hope we can attain clarity Jazaakumullaahu khairaa.

Text of the Fatwaa:

"She does not have to make up the days. She only has to expiate by feeding a needy person for every day. As for the condition mentioned i.e. if the pregnant and breast feeding women fear for themselves and their babies, then this condition is from the efforts of some of the Scholars. The pregnant and breast-feeding women don't have to have this condition because the Prophet Sallallahu alaihi wa sallam has said: "Allah Tabaaraka wa ta'aalaa has removed fasting from the pregnant and breast feeding women?. In addition, ibn 'Abbaas said regarding the tafseer of Allah's statement Ta'aalaa:
 Al-Baqarah (2):184
أَيَّامًا مَّعْدُودَاتٍ فَمَن كَانَ مِنكُم مَّرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ فَمَن تَطَوَّعَ خَيْرًا فَهُوَ خَيْرٌ لَّهُ وَأَن تَصُومُواْ خَيْرٌ لَّكُمْ إِن كُنتُمْ تَعْلَمُونَ

[Observing Saum (fasts)] for a fixed number of days, but if any of you is ill or on a journey, the same number (should be made up) from other days. And as for those who can fast with difficulty, (e.g. an old man, etc.), they have (a choice either to fast or) to feed a Miskîn (poor person) (for every day). But whoever does good of his own accord, it is better for him. And that you fast, it is better for you if only you know.

ibn 'Abbaas said Radhiyallahu 'anh: "The pregnant and breast-feeding women must feed." i.e. the condition previously mentioned is not found here that they must fear for themselves or their children. In summary, it is permitted for any pregnant woman or breastfeeding woman to break their fast and feed a needy person for each day and she does not have to make up the days only this expiation.
