هل يجوز للإنسان أن يفتي وهو يجهل حتى اللغة العربية، والعام والخاص، والمطلق والمبين؟

نص الفتوى  
الحمد لله
هذا لا يجوز أبدًا، هذا بلاء عم العالم الإسلامي حيث ظهر أناس عاميون يجعلون لأنفسهم مكتبات في بيوتهم يقرؤون فيها، ويخرجون على الناس بآراء وفتاوى لا يعرفون مصدرها ولا آثارها، لأن مثل هؤلاء قد يقرؤون الحروف ولا يفهمونها مثل العربي الذي يقرأ الحروف الأعجمية أو الأعجمي الذي يقرأ الحروف العربية، فكلاهما لا يفهم معانيها، وهذا ا>ى إلى تناولهم للأحاديث الشريفة ورواتها بالجرح والتصحيح وهم يجهلون ما يقولون، ومثل هؤلاء كالمجنون الذي جعل في يده سيفًا أو بندقية، وأخذ يهدد الناس أو مثل الذي يقود سيارة، وهو لا يتقن القيادة فيدخل بها إلى وسط الناس فهذا خطر شديد.
فالفقه شيء عظيم يجعله المولى عز وجل في قلوب من يشاء من عباده، وهو يحتاج إلى دراسة واعية ومثابرة، واجتياز مراحل دراسية حتى يصل الإنسان إلى هذا المنصب.


وَكَانَ الْفُضَيْل بْن عِيَاض يَقُول : يَا كَذَّاب يَا مُفْتَرٍ , اِتَّقِ اللَّهَ وَلَا تَسُبَّ الشَّيْطَان فِي الْعَلَانِيَة وَأَنْتَ صَدِيقُهُ فِي السِّرّ

Common Folks Making Fatwas (religious verdicts), by Ash-Shaikh Saalih Al-Fawzaan

Question: Is it permissible for the person to give religious verdicts while he is ignorant of even the Arabic language, and the general and specific, and the unrestricted and the evident?

Text of the Fatwaa
All praise is due to Allaah. This is never permissible. This is a trial that has covered the Islamic World where there has appeared common people who make libraries for themselves in their homes where they read and then they come out to the people with opinions and verdicts which they do not know the sources of, nor do they know the effects of them. This is because the likes of these people may read the letters and they do not understand them. This is like the Arab who reads the non-Arabic letters, or the non-Arab who reads the Arabic letters. So both of them do not understand their meanings. And this leads to their taking the noble hadeeths and their narrators with criticizing and authenticating, while they are ignorant of what they are saying. The likes of these people are like the crazy person who puts a sword or rifle in his hand and he starts threatening the people, or like the one who drives a car while he does not know how to drive, then he enters right into the middle of the people with it (the car). So this is a severe danger. So the Fiqh (understanding the Deen) is something tremendous, which the Lord, Mighty and Majestic, places it in the hearts of whoever He wishes of His slaves. It requires careful study, and diligence. And it requires passing levels of education until the person reaches to this position.
