السؤال:
هل يُصلى خلف إمام مسجد يقنت في الفجر ويدعو ويرفع يديه، وهل يُتابع، وإذا صلوا صلاة الاستسقاء في المسجد هل نصلي معهم ؟
الـجــواب:

إذا صلى الإمام وقنت فاقنت معه، مخالفة الإمام للمأموم حتى لو يرى أن صلاة الإمام ليست بصحيحة في مذهبه؛ هي صحيحة في مذهب هذا الإمام ولكنها ليست صحيحة عندك؛ صلّ وراءه، الرسول صلى الله عليه وسلمأمر بالصلاة وراءه وقال:(يُصَلُّونَ لَكُمْ فَإِنْ أَصَابُوافَلَكُمْ وَإِنْ أخطؤوا فَلَكُمْ وَعَلَيْهِمْ )(1) فتصلّ وراءه .

كان السلف؛ يعني جاء الرشيد إلى الحج ونزل في المدينة واحتجم، وسأل مالكا:احتجمت هل أصلي بدون وضوء ؟ قال : نعم صلّ، فصلى بالناس ولم يتوضأ من الحجامة .

عند الأحناف الحجامة تنقض الوضوء، فقيل لأبي يوسف : كيف صليت وراء الرشيد وهو احتجم ولم يتوضأ ؟ قال : سبحان الله، أمير المؤمنين!

ولشيخ الإسلام ابن تيمية كلام : أنك تصلي وراء الإمام إذا كنت تختلف أنت وإياه في قضية؛ ترى أنّ عنده باطل، صلاته ليست صحيحة لكن هو عنده أصول وعنده أدلة؛ يرى أن صلاته صحيحة، فصل ّوراءه ولو كنت لا ترى صحة صلاته فصلّ وراءه، إلا إذا تأكدت أنه لم يتوضأ؛ قال لك : أنا لا أتوضأ وأصلي بدون وضوء ! فصلاته باطلة عندك وعنده .

I am not in a position to translate but if you put the phrase "Qunut Fajr" (without the quotes) in the search box on the website www.alifta.com and click the Search button you will find quite a few fataawa on this topic which are translated into English.

In the name of Allah most merciful and especially merciful

Ash-Shaykh, al-'Allaamah, Rabee' bin Haadee al-Madkhalee (hafidhahullah) was asked:

Question:
Does one pray behind an Imaam of a masjid that makes Qunoot in Fajr and makes du'aa and raises his hands and do we follow him (in that)? And if they pray salaatul-Istisqaa' in the masjid, do we pray with them?


Answer:
If the imaam prays and makes qunoot, then make qunoot with him. The follower differing and opposing the imaam, even if he sees the salaah of the Imaam is not correct according to his madhhab, it is correct in the madhhab of this Imaam, but it is not correct with you ý pray behind him. The Messenger (Sallallaahu 'alayhi wasallam) ordered with the salaah behind him and said: "If they lead you in the salaah correctly, then they and you will receive the rewards but if they make a mistake (in the salaah), then you will receive the reward and the sin will be theirs." (1) So you pray behind him.
The Salaf used to, meaning Ar-Rasheed (the ameer) came for the Hajj and he stopped in Madeenah and had hijaamah (cupping) done, and he asked (Imaam) Maalik: 'I was treated by hijaamah, do I pray without (a new) wudhoo'.' He said: 'Yes, pray!' So he prayed with the people and did not make wudhoo' due to hijaamah.
With the Ahnaaf (the Hanafees), hijaamah nullifies wudhoo'. So it was said to Aboo Yoosuf, 'How did you pray behind Ar-Rasheed and he had hijaamah done and did not make wudhoo'?' He said: 'Subhaanallaah! (He is) Ameerul-Mu'mineen!'
And there is for Shaykhul-Islaam Ibn Taymiyyah some speech, that you pray behind the Imaam. If you differ and him in an issue; you see that what he has is false, his salaah is not correct, but he has usool (fundamental principles) and he has adillah (proofs) ý he sees his salaah is correct ý then pray behind him even if you don't see the correctness of his salaah, then pray behind him ý except if you are sure that he did not make wudhoo'. (like) he said to you: 'I do not make wudhoo' and I pray without wudhoo'.' Then his salaah is null and void, for you and him."

Amma ba'd

Ruling regarding saying 'ameen' aloud after du'aas are uttered, raising of the hands & the extra supplications

Excerpt: Shaikh 'Ubaid al-Jabiree (hafidhahullaah) said:

If, however, the Imam makes du'aa in a morning prayer, then you do not say 'Ameen,' as this is an innovation.

Secondly, regarding raising the hands during the Qunut, if this happens during a Qunut in Fajr, then you shouldn't raise your hands - this is an innovation - although the prayer still remains correct, but you shouldn't raise your hands eventhough your Imam persists in saying these supplications. As for this happening during the Qunut of Witr, to this day I have not come across any evidence or hadeeth proving this action as authentic.

what does the shaykh mean by this:

"As for this happening during the Qunut of Witr, to this day I have not come
across any evidence or hadeeth proving this action as authentic."


is he talking about raising hands and supplicating? i dont think so, because
there is daleel in the sunnah about the duaequnoot for the witr, raising the
hands, and saying ameen outloud behind the imaam with him, and also
additionally sending prayers upon the prophet sallallahu alayhi wa sallam
during ramadan...

please clarify inshaAllah what the shaykh means by this.
