Assalamu 3alaikum wa rahmat Allahi wa barakatu

I have a sincere question.  Being a muslim woman..i have been told time and time again a woman on her menses should not touch the mashaf without a cover and also should not memorize the Qur'an while on menses.  I have been told that it is permissible for a menstruating woman to recite what she knows of the Qur'an from memory so that she may not forget.  After reading this particular Fatwa, http://fatwa-online.com/fataawa/womensissues/menstruation/9991018_60.htm it shows me that it is permissible for a menstruating woman to read from the Qur'an,  Insha'Allah correct me if i am wrong as i am never far from error.  I would like to know....if a menstruating woman is allowed to Memorize while on her menses?  I have never been given daleel for the opposition of not memorizing.  Please also if you can provide daleel for either way this ruling occurs.  If it is impermissible i would like to know why and if it is permissible i need daleel also insha'Allah.

بسم الله الرحمن الرحيم

In his book "NATURAL BLOOD OF WOMEN" on pages 20 and 21 of the English translation (translated by Dr. Saleh S. As-Saleh) our Noble Shaykh Muhammad bin Saalih al-Uthaymeen (rahimahullaah) said:

quote:

"The reciting of the Qur'aan by a menstruating woman either via direct looking or silently (in her heart) without the actual uttering by the tongue is permissble.  The majority of the scholars are with the opinion that it is prohibited for her to utter the Qur'aan recitation.  Imaam Al-Bukharee, Ibn Jabeer At-Tabaree, Ibn Al-Monthir, Imaam Maalik, and Imaam Ash-Shaafi'ee (in one of his earlier sayings) are with the opinion that it is permissible for her to recite the Ayah."


Shaykh al-Uthaymeen (rahimahullaah) then brings the opinion of Shaykh-ul-Islaam Ibn Taimiyyah (rahimahullaah) who said:

quote:

"Basically, there is no Sunnah to prevent her from reciting Qur'aan.  The "hadeeth" that: "A menstruating woman and the one who is in state of Jannabah should not recite anything from the Qur'aan", is a weak hadeeth as agreed upon by the knowledgeable scholars of Hadeeth.   In fact, women at the time of the Prophet sallallahu alaihi wa salam used to have their monthly cycles of menses.  Had the recitation of the Qur'aan been prohibited for them (as it is the case with Salat) then the Prophet sallallahu alaihi wa salam would have made it clear to his Ummah and his wives would have known about it and they would have disseminated this knowledge to the people.  Because no one had related a prohibition by the Prophet sallallahu alaihi wa salam about this issue, then it can not be made unlawful especially when it is known that he did not prohibit it at the time when menses was very much present.  Accordingly, recitation by the tongue is not Haram"

Ibn Taimiyyah in Al-Fatawa  V. 26, P. 191


Shaykh al-Uthaymeen (rahimahullaah) ended by saying:

quote:

Having known the dispute between the scholars about this matter, then it is more proper for the menstruating woman not to recite Qur'aan by the tongue except when it is necessary e.g. if she is a teacher or if she is preparing for an exam"



Insha'Allaah this last statement by our Shaykh al-Uthaymeen (rahimahullaah) comes close to answering your question. Reciting while "preparing for an exam" seems to indicate memorizing, but the Shaykh (rahimahullaah) clarified that "reciting by the tongue" is based upon the condition of NECESSITY.
