From the magnificent book ?Silsilah al-Ahaadeeth as-Saheehah wa shai min fiqhihaa was fawaaidihaa? by the Noble Imaam, the Mujaddid, the Mujaahid, the Muhaddith Abu Abdur Rahmaan Muhammad Naasir ud-Deen al-Albaanee (rahimahullaah).

Hadeeth No. 775, Page 405

A woman needs her husbands permission to spend her own wealth.

?It is not for a woman to spend any of her wealth without the permission of her husband.?

Reported by Tamaam in ?al-Fawaaid? (10/182/2), at-Tabaraanee (22/83/201) and (85/206) and Ibn Asaakir (4/24).



The Shaikh (rahimahullaah) then discusses all the chains and mentions that even though there are some weak chains to the narrations, other supporting chains also exist, some of which are ?hasan li dhaatihi?, and are reported by at-Tahaawee (2/403) and Ahmad (5/327).


The Naasir us-Sunnah then says,

And the hadeeth, and what we have alluded to regarding its meaning, proves that it is not permissible for a woman to spend from her own wealth without the permission of her husband. And that is from the completion of the authority that our Lord, the Blessed and the Most High, has given men over women. However it is not befitting for the husband, if he is a truthful Muslim, to go to extremes in this ruling. Such that he becomes tyrannical over his wife and prevents her from spending her wealth in that which contains no harm for either of them.

And what resembles this is the situation of that of the walee of a girl who does not permit her to marry the person she wants unless it occurs by his permission. And when he prevents her, the matter is taken to a sharee? judge to give her the rights due to her. And similar is the ruling regarding the wealth of a woman when her husband persecutes her and prevents her from spending it in a legislated matter. Then the judge also gives her the rights due to her.

So there is no problem with the ruling (of needing the husbands permission) in and of itself, rather the problem comes from the evil behaviour (of those husbands who oppress their wives).
