Bismi'llaah wal hamdu lilaah was-salaatu wa salaam 'ala Rasulilaah wa ba'd:
as-salaamu 'alaikum wa rahmatullaahi wa barakatuh!
There is a current fitnah at our masjid regarding the issue of whether the Nabi (sallallahu 'alaihi wa salam) made mistakes or not. One of the brothers mentioned how the Nabi (sallallahu 'alaihi wa salam) had once made the mistake of only performing three rakaat for salatul-'isha instead of four. And after it was brought to his attention he (sallallahu 'alaihi wa salam) said, "I am only a human being, I make mistakes just like other human beings, so when you see me do that then correct me".
About a dozen brothers (mostly from Pakistan) began to raise their voices and said "It is impossible for the Prophet (sallallahu 'alaihi wa salam) or ANY prophet to make mistakes!" Upon hearing that, another brother said, "Perfection is an Attribute of Allaah and not the Prophet or any other human being".
I know there is a difference between making a Sharee'ah mistake and making a human mistake which the Prophet (sallallahu 'alaihi wa salam) was not above doing. Can one of the "Students of Knowledge" PLEASE expound on this issue. I also remember reading (but I can't recall from where) that the Prophet 'Isa ('alaihi as-salaam) once accused a man of theft by mistake. If brother Moosaa or other than him could identify the source of this hadeeth and explain the issue of Prophets not being able to make mistakes, it would be GREATLY appreciated. Also, could you provide examples of how and when some of the prophets made mistakes. THIS IS NOT FOR THE PURPOSE OF BELITTLING THEM, BUT RATHER TO SHOW HOW THEY WERE ONLY HUMAN BEINGS. waAllaahu 'alam.
I'm hoping that one of the Ulamaa will explain the distinction between a mistake which involves a sin and that of a simple human error. We know that the Nabi (sallallahu 'alaihi wa salam) did not make mistakes that were on the level of being a sin, but there seems to be some confusion about the different levels and types of "Mistakes" that needs clarification insha'Allaah, waAllaahu 'alam.

Wa alaikumussalamu wa rahmatullahi wa barakaatuh
I heard Shaikh Ubaid Al-Jaabiree (Hafidhahullah) say on a recording that the Ijtihaadaat of the Messenger of Allah Muhammad Sallallahu alaihi wa sallam were of three types:
1. That which revelation came down in accordance with.
2. That which revelation came down in opposition to.
3. That which the revelation was quiet about and this is considered to be an acceptable action.
This means that there were times when there was no revelation and the Messenger had to make a decision. If he made the correct choice, then number 1 would take place or number 3 i.e. there would be revelation promoting his action or there would be no revelation that means that the action was good. If the action or choice were not what Allah subhanahu wa ta?aalaa wanted then revelation would come down correcting the Messenger sallallahu alaihi wa sallam. I also recall hearing Shaikh Abdullah Al-Jarboo' saying that the only difference between the Prophets and us is that they receive revelation and we don't. I hope this helps.
