Shaykh 'Ubayd al-Jaabiree, who is from the major scholars, has stated that he deems the attending of mixed sex colleges and universities impermissible.

This is a significant ruling that, unfortunately, is seldom discussed and more often than not uncleverly ignored and disobeyed.

As-Salaamu alaykum:

As far as ?University Islamic Societies? and the issue of Muslims studying in Universities/academic institutes here in the U.K, then maybe one of the brothers can add in that regard the words of the Scholars.

As for the issue of the ?Ameer? in Islaam and the Sharee'ah, then this falls into two categories; either

1) The leader of the believers in a land, possessing the authority of government, "أمير المؤمنين"   ?Ameer ul-Mu.mineen?. He has the authority over the armies, courts, security etc. He is given obedience by the subjects.

He reaches authority in one of three ways:

a.     By way of appoinment by the preceding authority, such as a Khalifah or a King.
b.     By way of force and gaining ascendancy over the people, even by way of oppression. Even if he reaches authority in a tyrannical manner, he is given obedience. And his accounting is with Allaah for his tyranny.
c.     By way of being chosen by those carrying influence in society, such as the scholars, governers and judges.

2) The Ameer upon a journey:

This can be clarified by a Hadeeth quoted in ?سلسلة الأحاديث الصحيحة ? by al-?Allaamah Muhammad Naasir ud-Deen al-Albaani (rahimahullaah), wherein the Prophet (salallaahu alayhi wasallam) said:  


إذا خرج ثلاثة في سفرٍ فليؤمرّوا أحدهم  


رواه أبو داود 2608/2609


?If three (people) set out upon a journey, then let one from them be the Ameer.?


سلسلة الأحاديث الصحيحة. رقم 1322

This Ameer is not given the bai'ah nor the obedience of the Ameerul-Mu'mineen that is over a land. Further, it is restricted to the journey only.

So as for the issue of electing an ?ameer? over a land by way of a democratic model whereby every person has a voice, the ignorant, the scholar, the fool, the intelligent, the righteous and the faasiq, the believer and the unbeliever, then this has with it no proof and no Salaf.

I'd like to ask - what is the correct islaamic way of electing an ameer?

(for an islaamic society which has been established based on the qur'an and sunnah at an academic institution).

Any advice or examples from time of prophet muhammad salallaahu alayhi wasallam and his companions?

If someone could please get this question answered along with any evidence, it will be much appreciated.
