  Decree No. 239, dated Rabi` Al-Thany 27, 1431 A.H.

All praise be to Allah, the Lord of the Worlds; and peace and blessings be upon our Prophet Muhammad, his family, and Companions. To proceed:

In its 20th extraordinary session, the Council of Senior Scholars held in Riyadh, on Rabi` Al-Thany 25, 1431 A.H., refers to its previous decrees and statements issued to condemn those who make mischief on earth causing security to be disturbed and committing grave violations of sanctity in Muslim and non-Muslim countries. This includes the Decree dated Muharram 12, 1409 A.H., and the Statements dated Jumada Al-Thany 22, 1416 A.H.; Safar 13, 1417 A.H.; and Jumada Al-Thany 14, 1424 A.H.

The Council viewed the ruling on "the Financing of Terrorism" from the perspective that terrorism is a crime which targets corruption, undermines security, and constitutes a grave offense against innocent lives as well as against public and private property. Terrorist acts include destroying houses, schools, hospitals, factories, bridges, and state-owned public resources, including oil and gas pipelines, as well as hijacking and attacking planes and other subversive activities, which are legally prohibited. It also regarded "the Financing of Terrorism" as a form of complicity and a way of sustaining and spreading it.

Moreover, the Council looked into the textual evidence from the Book, the Sunnah, and Shari`ah rules that incriminate "the Financing of Terrorism." Allah (Glorified and Exalted be He) says: Help you one another in Al-Birr and At-Taqwa (virtue, righteousness and piety); but do not help one another in sin and transgression. [Surah Al-Ma'idah, 2.] And: And of mankind there is he whose speech may please you (O Muhammad (sallallaahu alayhi wasallam)), in this worldly life, and he calls Allýh to witness as to that which is in his heart, yet he is the most quarrelsome of the opponents. And when he turns away (from you "O Muhammad (sallallaahu alayhi wasallam) "), his effort in the land is to make mischief therein and to destroy the crops and the cattle, and Allýh likes not mischief. [Surah Al-Baqarah, 204-205.] And: And do not do mischief on the earth, after it has been set in order. [Surah Al-A`raf, 56.] It is related in Sahih Muslim on the authority of `Aly (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) said:

In Fat-h Al-Bary, Al-Hafizh ibn Hajar (may Allah be merciful to him) said:


It is firmly established in the Islamic Shari`ah that the means to do something have the same ruling as that of the ends of such doing. In addition, the Shari`ah provides for safeguarding and protecting rights and commitments in Muslim or non-Muslim countries.

Accordingly, the Council decided that financing terrorism or attempting it is prohibited and constitutes a punishable crime; this includes providing or collecting money for it, or participating in it by any means that includes doing so by utilizing financial or non-financial assets, regardless whether they are legally or illegally acquired.

Anyone who intentionally commits this crime is guilty of committing a prohibited act and deserves the legal punishment according to the discretion of justice.

The Council asserts that just because it is not allowed to finance terrorism, it does not mean that providing money to support charitable means that provide livelihood, treatment, and education for the poor is not permitted, for this is a right of the needy which Allah (Exalted be He) imposed on the rich.

By declaring this ruling, the Council calls upon all Muslims to adhere to the teachings of their religion and the righteous path of our Prophet (peace be upon him), and to refrain from any act that might cause harm to other people or transgress against them.

We invoke Allah (Exalted be He) to give us all that is good, safeguard the unity and prosperity of this country, the Kingdom of Saudi Arabia, and other Muslim countries, improve the lives of all mankind, and help spread virtue and justice throughout the world. Allah is the Guide and He is the One Who directs to the righteous path.

May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
