Can someone tell me whats the legislated ruling concerning brothers in prison with regards to the paying of Zakat ul Fitr.(IS it still binding on them to pay it?)

We presented this question to the Shaykh Allaamah Ubaid ibn Abdillaah Al-Jabiri on 25/11/2002.


Those who have been confined in prison, do they have to pay Zakaat ul Fitr?


The Shaykh responded:

The one who is imprisoned, then if he is Mukallaf someone of sound intellect and has reached puberty, then verily Zakaatul fitr is obligatory upon him even if he is confined (in prison). Because this Zakaat is upon the heads, upon their necks, each muslims (responsibilty) of Zakaat is upon himself.
But if the one who is confined, his family like his wife, son or father was to arise (with this task) for him with his permission then there is nothing wrong with this.




وقال شيخ الإسلام ابن تيمية:
لا عيب على من أظهر مذهب السلف وانتسب إليه واعتزى إليه بل يجب قبول ذلك منه بالاتفاق فإن مذهب السلف لا يكون إلا حقا

Shaykh Ubayd al-Jaabiree answers:
Does the prisoner have to pay Zakaatul Fitr?




Hudhayfah ibn al-Yamaan radiallaahu 'anhu said. "The people used to ask the Messenger of Allaah sallallaahu 'alayhi wa sallam about the good, but I used to ask him about the evil for fear that it would overtake me ..."

You mentioned the wife ,son or father....Does this also apply to ones blood brother? This was a question asked to me by a companion of mine, Masha Allah and Alhamdulillah the questioned was asked ...I just want to be clear on his relationship to the person confined before I relay this to him....Barakallahu feekum.......
