Topic: Hadith Authenticity?

I would be very grateful if any student of knowledge or anyone could shed some light on this hadith

  The Muhaddith of our time Shaykh Muhammad ibn Nooh an-Najjaatee has stated that al-Imaam al-Bukhaaree said this hadeeth is munkar.

In addition to this, Shaykh an-Najjaatee said this hadeeth gives the ruler a method of three stages which disallows searching for any rule with regard to personal views or opinions with the exception that he does locate it in the Sunnah and if not in the Sunnah, except that after that he does not find it in the Book of Allaah.

Then the Shaykh explained how this is a incorrect method of deriving rulings and that it is essential to search for a ruling in Sunnah, even if he thinks it is found in The Qur'aan as we have mentioned it. Sunnah is not with The Qur'aan in the same manner as personal opinion with the Sunnah.

And that it is absolutely a requirement to regard the Book of Allaah and Pure Sunnah as being one source with no distinction between the two whatsoever with regard to legislation.

And the proof the Shaykh used for this is in an authentic hadeeth of the Prophet sallallaahu alayhe wa sallam: "Indeed I have come with the Qur'aan and something similar to it" ie. the Sunnah and that they will never be separated until they reach to the Pool.

As-Salaamu Alaykum wa rahmatullaahi wa Barakaatuhu! Sheikh Naasirud-Deen Al-Albaani [rahimahullah] mentions that ,this narration is not authentic. Check the Da'eef of Aboo Dawood pg. 354. hadeeth number 880-3592 also collected by tirmidhi[1350] and mishkat al masaabeeh [3737]. Hope this helps.
